Booking Conditions

Operator. Luxury Cubelles Aparthotel, Carrer Charlie Rivel 52, 08880 Cubelles, Barcelona, Spain. Tourist registry number HB-005114-64. By completing a booking you accept these terms and conditions.

1. Prices and taxes. All prices are shown in euros and include applicable taxes and fees. The base rate covers 2 people. Additional guest per night: under 2s free; children aged 2 to 10, 10 EUR; adults and children over 10, 20 EUR. Cots and baby high chairs free on request. Apartments 101 (up to 6 people) and 103 (up to 2 people) have fixed pricing, with no additional guest fee within those limits.

2. Payment and terms at check in and check out. A credit card is required to confirm the booking. 50% of the total is charged at the time of booking and the remaining 50% is charged 48 hours before arrival. Arrival is from 3:00 PM via digital self check in: you receive your access code on arrival day, there is no front desk, and you may arrive any time after 3:00 PM. Departure is by 11:00 AM. Early check in or late check out for 30 EUR per service, subject to availability. During your stay an assistance phone, also on WhatsApp, is available for any issue: 616 01 79 83.

3. Cancellation. Flexible rate: free cancellation up to 10 days before arrival with a 100% refund of any payment. Between 10 days and 48 hours before arrival, 25% of the total is charged. Between 48 hours and the day of arrival, 50% is charged. On the day of arrival or for a no show, 100% is charged. Non refundable rates are not refundable, except in force majeure situations under clause 15, in which case we will offer the most reasonable solution possible (date change or another alternative). Bookings of two or more apartments follow group terms: free cancellation up to 20 days before arrival and a 50% non refundable deposit thereafter.

4. Traveling with minors. Minors are welcome and must be listed in the booking. They must be accompanied and supervised by a responsible adult at all times, especially at the pool, where access by minors without a responsible adult is never permitted. The lead guest must be over 18 and stay at the apartment.

5. Accessibility and special needs. Apartment 103 is adapted for guests with reduced mobility. For any special needs, contact us on WhatsApp before booking to confirm availability.

6. Parking. The apartment has no private parking. Parking is on the street, in a free and unregulated residential area located next to the Cubelles Local Police station.

7. Events and parties. Parties, events and gatherings are not allowed. Only the guests included in the booking may stay, up to the apartment maximum capacity, with no unregistered visitors.

8. House rules. No smoking indoors; allowed only on the terrace, garden or balcony. No pets. Residential area with quiet hours from 10:00 PM to 8:00 AM. The pool is for guests only and has no lifesaving, first aid or bather supervision service, as stated on the notice posted in the pool area. Access to the pool by minors without a responsible adult present is never permitted (see clause 4).

9. Complaint forms. We hold official consumer complaint forms (queixa/reclamació/denúncia) available to you, in line with Catalan consumer protection regulations. You can request them on WhatsApp at 616 01 79 83 and we will send them along with the details of the competent body to process them.

10. Traveler registration. Under Spanish law (Royal Decree 933/2021), all guests must provide their details and ID document before arrival. This data is transmitted to the Ministry of the Interior SES.Hospedajes system and, in Catalonia, to the Mossos d'Esquadra, in compliance with a legal obligation. It is a legal requirement to complete the stay; without it we cannot formalize your check in.

11. Damages. The guest is responsible for any damage caused during the stay. If we detect damage, we will notify you in writing (email or WhatsApp) within a maximum of 3 business days after departure, stating the detail and an estimated cost, with photos or a quote where possible. You will have 7 days from the notification to submit comments. After that period without comments or agreement, Luxury Cubelles Aparthotel may charge strictly the amount of the substantiated damage to the card provided at booking.

12. Dispute resolution. These terms are governed by Spanish law. Any dispute will be submitted to the courts having jurisdiction under consumer protection regulations, including the courts of the guest domicile when acting as a consumer.

13. Use of personal information. We process your data in accordance with the General Data Protection Regulation and our Privacy Policy, to manage your booking and stay, meet our legal obligations (including the traveler registration in clause 10) and, where applicable, send you communications if you have given consent. 14. Liability. Luxury Cubelles Aparthotel is not liable for loss, theft or damage of personal belongings, nor for harm arising from causes beyond its control. Our liability, where applicable, is limited to the value of the booking, except in the event of death or personal injury caused by the negligence of Luxury Cubelles Aparthotel, or where consumer regulations do not permit such limitation.

15. Force majeure. We are not liable for failure to perform caused by circumstances beyond our reasonable control. Outside your rate cancellation terms, no automatic refunds are issued for reasons beyond the property such as flights, weather or personal reasons. We recommend taking out travel insurance.

16. Third party rights. These terms bind only the guest and Luxury Cubelles Aparthotel. No third party acquires rights under them.

17. Waiver. Failure to enforce any of these conditions at any time does not waive the right to enforce it later.

18. Severance. If any clause is found void or unenforceable, the remaining terms stay in effect.
